Why is the contempt notice Important?
The karamchari Parishad is preparing for legal battle yet again in the supreme court while making ultimatum to the chief secretary of finance and home saying that it shall move a contempt notice to these offices as the deadline of the DA dispersal is coming to an end on 26th June . They say that failure to making any postive move till 26th June , the Parishad will move forward with the notice to the chief secretaries of the government department giving them a deadline to fill fill the supreme court order as per 25% DA is concerned.
The deadlines is near and the employees council the karamchari Parishad seems firmed with the legal procedure to sue to the government yet again and the government cannot get their hands out of it . The solutions only seems that the government shall be proceeding with the distribution of the 25% DA allowance as per supreme court order.
What is a contempt of court notice?
For your legal understanding the contempt of court notice is preferably a legal document being issued through a lawyer to the concerning body for not following the High court or supreme court order or judgement as prescribed in the court and the judgement and this can be a strong case against the body to which the court has ordered to follow the rules, order and the judgement. The contempt of court is serious action against those who donot comply with the high court or supreme court order. For example here in the 25% DA allowance case it's the West Bengal Government who has to accept the supreme court order or face the contempt of court notice and legal procedures.
Legal actions and the Events of DA cases
Mr Debashis Babu mentioned that the next hearing in the apex court is on August 14th , and that might be the actual day when the case of contempt of court may be raised in the hearing of the government doesn't comply with the order. The legal battle is being put forward to not only to get the legal and fundamental rights but also to set future precedents for the government to act without prejudice and discrimination having sure that the government should go ahead with governance keeping in mind the due actions for equal pay for equal work.
Conclusions
As the 25% DA allowance case is taking new shapes daily without keeping in mind that supreme court order is sacrosanct untill reviewed or appealed to challenge in the apex court. The supreme court order is green flag for dispersal of the funds to government employees by 25% DA allowance. The situation here seems dark in relationship with the government employees and the state. As the case goes to Apex court by 14th August 2025 , the government employees are all vigil and looks forward to availing their legal rights.
